    Self-managed strata FAQ

    By-laws and disputes

How self-managed buildings keep the peace and resolve problems fairly.

How do we change our strata by-laws?By-law changes usually need a special resolution at a general meeting and must then be registered with your state's land titles office before they take effect. Draft the wording carefully and get advice for anything complex. How do we enforce a by-law?Start with a friendly conversation or letter. If the problem continues, send a formal notice following your state's process. If it still isn't fixed, the owners corporation can apply to the relevant tribunal, which may make orders or impose penalties. How do we handle noise, pets and parking complaints?Check what your by-laws say, talk to the people involved and try to agree a practical fix. Many complaints are solved early this way. If not, follow the by-law enforcement process. Pet rules in particular have changed in several states, so check current law. What can the committee do about disputes between neighbours? The committee should only get involved where a by-law or common property is affected. Purely personal disputes between owners are usually theirs to resolve, though the committee can point them to free mediation services. When should a strata dispute go to the tribunal? When conversation, formal notices and mediation haven't worked. Each state has a tribunal or body that decides strata disputes, and many require mediation first. Keep all records and notices as evidence.
